The article presents a vision of the place of the state innovation policy in the Russian legislative system. There is a need to improve the norms of the Russian law in the field of innovation management. The article highlights, that the need to create a coherent system of rules of law governing innovation activities, is caused by increase of efficiency of realization of measures of a state policy on development of national system of innovation as a new sphere of management.
